In 2002, France created its own Trade Register or the Registry of Commerce and Companies (Registre de Commerce et des Sociétés) that is regulated by the Act that was enforced since December 19, 2002. The Trade Registry falls under the authority of the Ministry of Justice in France. The management of the Registry of Commerce is provided by the State Chamber of Commerce and the Chamber of Trade.

The primary function of the French Register of Commerce is to register companies and individuals conducting an economic activity. The Trade Register is also in charge with updating the database of existing French companies and other legal entities. The information that can be found in the French Trade Register refers to full name, address and other data about sole traders and company name, social capital, the date of incorporation and the company’s structure.
The Register of Commerce and Companies in France also receives the documents required for company incorporation, it updates any changes brought to the company and also radiates companies that cease to exist by dissolution or any other way.
The Trade Register also issues the Kbis extract (Extrait Kbis) which is basically the identification document of a French company. It contains verified data and confirms the legal existence of the company.
The most important role of the Trade Register in France is to register new companies, which is an obligatory step to be taken when setting up a company. All required documents must be submitted with the Commercial Court in order to receive the company’s Incorporation Certificate.
Starting 2005, the registration procedure can be done by submitting the documents online which simplified and speeded the process. All the applicants must do is to connect to the platform, fill in the application and select the type of company to be registered, attach the required documents and pay the registration fee. Once the registration is completed, the applicant will receive the Kbis extract.
As mentioned above, when incorporating a company with the French Commercial Register, the applicant must select the type of company to be registered. According to the French Company Law, the following types of companies are available for registration:
Each one of these companies is subject to specific provisions on which our lawyers in France can provide information.
